STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eleven
AN ACT requiring that New Hampshire join the lawsuit challenging federal health care reform legislation.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Lawsuit Challenging the Federal Patient Protection and Affordable Care Act. The attorney general shall, as soon as practicable, join the lawsuit (State of Florida et al. v. United States Department of Health and Human Services et al.) challenging the constitutionality of the Patient Protection and Affordable Care Act.
2 Effective Date. This act shall take effect upon its passage.

HB 440 FISCAL NOTE
AN ACT requiring that New Hampshire join the lawsuit challenging federal health care reform legislation.
FISCAL IMPACT:
The Department of Justice states this bill, as amended by the House (Amendment #2011-2718h), may increase state expenditures by an indeterminable amount in FY 2012 and each year thereafter. There is no fiscal impact on county and local expenditures, or state, county and local revenue.
METHODOLOGY:
The Department of Justice states this bill directs the Attorney General to join the lawsuit entitled State of Florida et al. v. United States Department of Health and Human Services et al. The Department states the lawsuit is now on appeal. The Department would have increased costs associated with participation in telephone conferences, research and drafting or editing of pleadings and briefs. The Department is not able to predict the course of an appeal to determine the fiscal impact.
