STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT requiring hospitals to provide Medicaid patient outpatient services at outpatient Medicaid rates for certain hours.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Medicaid Patient Outpatient Services. Amend RSA 151 by inserting after section 21-b the following new section:
151:21-c Medicaid Patient Outpatient Services. Hospitals licensed pursuant to this chapter shall provide Medicaid patient outpatient services at outpatient Medicaid rates for 20 hours per day.
2 Effective Date. This act shall take effect 60 days after its passage.

HB 1519-FN - FISCAL NOTE
AN ACT requiring hospitals to provide Medicaid patient outpatient services at outpatient Medicaid rates for certain hours.
FISCAL IMPACT:
The Department of Health and Human Services states this bill will have an indeterminable fiscal impact on state revenue and expenditures in FY 2013 and each year thereafter. There will be no fiscal impact on county or local revenue or expenditures.
METHODOLOGY:
The Department of Health and Human Services states this bill requires hospitals to provide outpatient services at applicable outpatient rates for 20 hour per day. The Department indicated outpatient services are a class of services subject to various fee schedules, the reimbursement rates do not vary depending upon the time of day, and the amount billed by a hospital is seldom equal to the amount paid by Medicaid. In addition, the Department states, if hospitals were to charge a different amount 4 hours per day, the Medicaid program would pay the same applicable rate as outlined on the fee schedule for that service. The Department is not able to determine the fiscal impact of this bill.
