STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twelve
AN ACT to return certain insurance exchange moneys to the federal government.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Funds From Exchange Planning Grant Returned. The insurance commissioner shall return $333,000 in exchange planning grant funds awarded the insurance department by the federal Department of Health and Human Services for purposes related to the potential implementation of a state-designed health benefit exchange under the Patient Protection and Affordable Care Act.
2 Effective Date. This act shall take effect upon its passage.

HB 1727-FN - FISCAL NOTE
AN ACT to return certain insurance exchange moneys to the federal government.
FISCAL IMPACT:
The Insurance Department states this bill will decrease state restricted expenditures by $333,000 in FY 2012. There is no fiscal impact on county and local expenditures, or state, county, and local revenue.
METHODOLOGY:
The Insurance Department states this bill directs the Department to return $333,000 in exchange planning grants to the federal Department of Health and Human Services. The Department states this bill will result in the state not being able to use $333,000 in federal funds. As the Department does not technically hold the funds, there are no funds to return to the federal Department of Health and Human Services. The Department would not draw or request any more from the funds that have been made available under this grant award to meet the intent of this bill. As a result of not being able to access the $333,000 of federal funds, state restricted expenditures will decrease by a like amount.
