STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Thirteen
AN ACT relative to antique vessel registration.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Registration Expiration. Amend RSA 270-E:3, V to read as follows:
V. All registrations issued under this chapter shall expire on December 31 next following the date of issuance unless sooner terminated by the department, except that a private vessel manufactured more than 70 years before the date of registration may be registered as an antique vessel and the antique vessel registration shall not expire until ownership of the vessel is transferred.
2 New Paragraph; Registration Fees for Antique Vessels. Amend RSA 270-E:5 by inserting after paragraph IV the following new paragraph:
V. A private vessel manufactured more than 70 years before the date of registration may be registered as an antique vessel upon presentation of proof of date of manufacture and a one-time registration fee of $100, which shall be in lieu of any other fees due under this section. From this $100 fee shall be paid the following:
(a) $22.50 shall be paid into the lake restoration and preservation fund established under RSA 487:25.
(b) $3 shall be paid into the fish and game search and rescue fund established under RSA 206:42.
(c) $15 for each registration processed by an authorized agent of the department who is not an employee of the department shall be retained by the authorized agent as compensation for processing the registration.
(d) $15 shall be paid into the statewide public boat access fund established under RSA 233-A:13.
(e) $6 for each registration for tidal or coastal waters shall be paid into the harbor dredging and pier maintenance fund established under RSA 12-G:46.
3 Search and Rescue Fund. Amend RSA 206:42 to read as follows:
206:42 Fish and Game Search and Rescue Fund. The additional fee of $1 collected under the provisions of RSA 270-E:5, II(b) for each private boat registered, under RSA 215-A:23, X for each OHRV registered, and under RSA 215-C:39, XI for each snowmobile registered, and the $3 of the antique vessel registration fee designated under RSA 270-E:5, V(b), shall be paid over to the state treasurer who shall keep such fees in a special fund to be expended by the fish and game department for use in search and rescue operations. The special fund shall be nonlapsing. All funds received under this subdivision are continually appropriated to the fish and game department for the purposes of this subdivision. The fish and game department shall report to the fiscal committee on a quarterly basis beginning on October 1, 1989, on the expenditures made from the fund.
4 Reference Added. Amend RSA 6:12, I(b)(42) to read as follows:
(42) Moneys received under RSA 233-A:13 and RSA 270-E: 5, II(d) and V(d) which shall be credited to the statewide public boat access fund established in RSA 233-A:13.
5 Boat Access Fund. Amend RSA 233-A:13 to read as follows:
233-A:13 Statewide Public Boat Access Fund Established. There is hereby established a nonlapsing statewide public boat access fund. The $5 boat registration surcharge collected pursuant to RSA 270-E:5, II(d), the $15 of the antique vessel registration fee designated under RSA 270-E:5, V(d), and any other public access funds donated to the state shall be placed in this fund. All funds received under this section are continually appropriated to the fish and game department for the purposes of the statewide public boat access program established under this chapter.
6 Disposition of Revenue. Amend RSA 270-E:7 to read as follows:
270-E:7 Disposition of Revenues.
I. Except as provided in paragraph II, all fines collected under this chapter, [and] the amount of fees generated by RSA 270-E:5, I and III, and the amount of fees generated by RSA 270-E:5, V that are not otherwise designated under RSA 270-E:5, V(a)-(e) shall be deposited in the navigation safety fund established under RSA 270-E:6-a.
II. All fees collected under RSA 270-E:5, I and III, and the amount of the fees generated by RSA 270-E:5, V that are not otherwise designated under RSA 270-E:5, V(a)-(e), for vessels registered for tidal and coastal waters shall be made available to the Pease development authority, division of ports and harbors for the purposes of safety, navigation, training, and administration. Such sums shall be nonlapsing and shall be continually appropriated to the Pease development authority, division of ports and harbors.
7 Lake Restoration and Preservation Fund. Amend RSA 487:25, I to read as follows:
I.(a) The fee of $7.50 collected under the provisions of RSA 270-E:5, II(a) shall be paid to the director of the division of motor vehicles. The director of the division of motor vehicles shall pay over said fee to the state treasurer who shall keep the fee in a special fund to be expended by the department of environmental services. The department shall use $.50 of the fee for lake restoration and preservation measures, exclusive of exotic aquatic weed control, $3 of the fee for the control of exotic aquatic weeds, and $4 of the fee for the milfoil and other exotic aquatic plants prevention program. The department shall deposit the $4 into a special account within the lake restoration and preservation fund which shall be used to administer the milfoil and other exotic aquatic plants prevention program. The special fund shall be nonlapsing. All funds received under this section are continually appropriated to the department for the purposes of this subdivision.
(b) The $22.50 of the antique vessel registration fee designated under RSA 270-E:5, V(a) shall be paid to the director of the division of motor vehicles. The director of the division of motor vehicles shall pay over said fee to the state treasurer who shall keep the fee in a special fund to be expended by the department of environmental services. The department shall use $1.50 of the fee for lake restoration and preservation measures, exclusive of exotic aquatic weed control, $9 of the fee for the control of exotic aquatic weeds, and $12 of the fee for the milfoil and other exotic aquatic plants prevention program. The department shall deposit the $12 into the lake restoration and preservation fund.
8 Effective Date. This act shall take effect January 1, 2014.

AN ACT relative to antique vessel registration.
FISCAL IMPACT:
The Department of Safety states this bill, as introduced, will increase state and county revenue by $14,335 in FY 2014, and decrease state and county revenue by $19,165 in FY 2015 and $12,192 in FY 2016 and each year thereafter. The Department states the bill will increase state expenditures by $36,475 in FY 2014. There will be no impact on local revenue, or county and local expenditures.
METHODOLOGY:
The Department of Safety states this bill creates a new, one-time registration for antique vessels, which shall not expire until ownership of the vessel is transferred. The $100 registration fee would be in lieu of several existing fees currently assessed on all vessels on a yearly basis. These existing fees are:
• $7.50 to be paid into the lake restoration and preservation fund, as established in RSA 487:25;
• $1 to be paid into the fish and game search and rescue fund, as established in RSA 206:42;
• $5 to be paid into the statewide public boat access fund, as established in RSA 233-A:13;
• For boats registered for tidal or coastal waters, $2 to be paid into the harbor dredging and pier maintenance fund, as established in RSA 12-G:46; and
• For registration fees purchased from an authorized agent of the Department of Safety who is not an employee of the Department, $5 to be paid to the agent as compensation for processing the registration.
The bill eliminates the above yearly fees for antique boats, instead allocating the following amounts from the one-time registration fee: $22.50 to the lake restoration and preservation fund; $3 to the fish and game search and rescue fund; $15 to the statewide public boat access fund; $6 to the harbor dredging and pier maintenance fund; and $15 to agents as compensation for processing the registration. For boats not registered for tidal or coastal waters, the balance is to be deposited into the navigation safety fund, as established in RSA 270-E:6-a. For boats registered for tidal or coastal waters, the balance is to be appropriated to the Pease Development Authority for the purposes of safety, navigation, training, and administration.
The Department states there are currently 335 boats registered in the state that would qualify as antique under the bill. Based on the numbers for the general boat population, the Department assumes that of these 335, four percent, or 13 boats, will be registered for tidal or coastal waters, while the remaining 322 will not. The Department also assumes that 60 percent, or 201 boats, will be registered directly by the Department, while the remaining 134 boats will be registered by authorized agents of the Department. Finally, the Department states that as a result of the bill, it will expend $36,475 to make database programming changes in FY 2014. The Department projects the bill will impact state funds as follows:
